Article 1 – Applicability

These general terms and conditions apply to every visit to the website www.mr-refurb.nl and to all quotations, orders, and agreements between Mr-Refurb and its customers. By using our website or placing an order, you declare that you agree to these terms and the associated privacy and returns policies.

Article 2 – Services and products

Mr-Refurb sells and supplies refurbished IT equipment and related services via a platform hosted by Shopify Inc. All products are carefully tested and supplied with a warranty, unless otherwise stated. The images and specifications shown are for illustrative purposes; minor deviations may occur.

Article 3 – Prices and payments

All prices are stated in euros and include VAT (or are subject to the margin scheme, where applicable), unless otherwise indicated. We reserve the right to change prices and product information without prior notice. Payment is made using the payment methods available on our website. In the event of payment problems, we reserve the right to cancel the order.

Article 4 – Orders and delivery

An agreement is concluded as soon as you place an order and we confirm it by email. Delivery will be made to the address you provided. The stated delivery times are indicative. Delays do not entitle you to compensation or cancellation of the agreement.

Article 5 – Right of withdrawal and returns

Consumers have a 14-day withdrawal period after receiving the product. Within this period, you may cancel the purchase without giving a reason, provided that the product is returned in its original condition and packaging. Business purchases (B2B) are not covered by the right of withdrawal. Details about returns and refunds can be found in our Returns and Refunds Policy.

Article 6 – Warranties and service

Our refurbished products are delivered with a minimum of 12 months’ warranty, unless otherwise stated. The warranty covers manufacturing or hardware defects, not:

damage caused by improper use, falls, or water damage;
software, configuration, or virus-related problems;
normal battery wear or cosmetic signs of use.

In warranty cases, we assess whether repair, replacement, or a refund is appropriate.

Article 7 – Liability

Mr-Refurb is not liable for indirect damages such as loss of profits or data, consequential damages, or business damage. Our total liability is in all cases limited to the amount of the relevant order. We make every effort to keep our website up to date and error-free, but cannot guarantee absolute accuracy.

Article 8 – Intellectual property

All content on the website (texts, images, logos, layout) is the property of Mr-Refurb or its licensors and may not be copied or reused without written permission.

Article 9 – Personal data

Your data is processed in accordance with our Privacy Policy. We use your data exclusively to process orders and provide customer service.

Article 10 – Force majeure

Mr-Refurb is not liable for delays or failure to fulfil obligations due to force majeure, such as supplier disruptions, strikes, natural disasters, or internet outages.

Article 11 – Prices

Unless expressly stated otherwise, all prices listed in communications such as catalogues, price lists and/or quotations from Mr-Refurb are expressed in euros and exclude turnover tax. Unless expressly stated otherwise, the costs of packaging and shipping, as well as any levies or taxes relating to the products and their transport, are borne by the consumer.

The displayed prices of the products include 21% VAT, unless stated otherwise. Margin scheme products are subject to a VAT rate of 0%. This is clearly indicated at checkout, so that consumers always know which VAT rate applies.

Prices are based on the conditions applicable at the time the agreement is concluded, including, among other things, exchange rates, freight rates, import duties, and dealer prices. If these conditions change before delivery, Mr-Refurb is entitled to pass on the additional or reduced costs.

Discounts are deemed to have been granted on a one-time basis each time. Discounts granted previously do not bind Mr-Refurb in any way with regard to subsequent agreements.

Article 12 – Applicable law and disputes

All agreements are governed exclusively by Dutch law. Disputes shall be submitted to the competent court in Utrecht, unless mandatory law provides otherwise.

Article 14 – Indemnification

The customer indemnifies Mr-Refurb against all third-party claims related to the use of products or services supplied by Mr-Refurb, insofar as the damage cannot be attributed to Mr-Refurb.

Article 15 – Responsibility for Software and Updates

Choice of software: The customer acknowledges and agrees that they are solely responsible for choosing hardware and software options and settings from the possibilities offered by Mr-Refurb. The customer accepts all risks associated with these choices, such as compatibility, limitations, and performance.

Software after delivery: Mr-Refurb is not responsible for software installed by the customer or third parties after delivery, nor for any problems or limitations arising from this.

Software updates: Mr-Refurb is not responsible for managing or installing software updates on the supplied hardware. The customer is responsible for keeping updates up to date and for the consequences thereof, such as possible functional limitations or data loss.

Article 16 – Transfer of Rights and Obligations

Mr-Refurb may transfer rights and obligations under the agreement to third parties, provided that this does not prejudice the customer's rights. The customer may transfer their rights or obligations only with the written consent of Mr-Refurb.

Due to the extensive range and diversity of our products, not all product photos are necessarily representative of the specific product supplied.
